At one time, I was a Florida residents having graduated from Pensacola Junior College and the University of West Florida. Military service and employment opportunities delayed my return to Florida. However, I am looking forward to moving to Florida within the next one to two years. I am also the owner of a vintage 1990 Nissan 300ZX Twin Turbo sports car. In 2000, I purchased a stainless steel, high performance B&B exhaust system. At that time it was legal in all 50 states. I understand from newspaper accounts that Florida recently passed vague legistlation making the type of exhaust system that I own subject to being interpreted as being illegal based on the discretion/interpretation of the police. "Florida law states that no vehicle, including cars, trucks, motorcycles, or boats can have modified exhaust systems." My car passes very stringent Virginia emissions and annual safety inspections. I have no problem with the police citing someone that is making excessive noise with their vehicle, but i do have a problem with police citing someone because they have an aftermarket high performance exhaust system on their car. The law as written is not being fairly applied, is excessively vague and puts police officers in the position where his or her actions will be challenged in the courts. A spokesperson with the Alachua County Sheriff's Office says the department has received complaints from residents throughout the county about loud noises from motors. "We're getting complaints from people driving with loud stereos to modified exhaust systems on cars, boats, and motorcycles," says deputy Stephen Maynard.
Deputies will receive training in the next few weeks about what type of muffler is legal and illegal. Florida law states that no vehicle, including cars, trucks, motorcycles, or boats can have modified exhaust systems. Some modified systems are legally sold, but for racing and show purposes.
Maynard says many of the modified systems are louder than normal and produce more emissions than allowed by the state. Those that can be heard from a distance are in a violation of the area's noise violation ordinance.
Car Enthusiast Michael Clapp says he knows people who have already been cited for having an illegal muffler, and says he understands why the deputies will be on the lookout, but hope they don't go overboard with the tickets.
"If a guy who lived next to me had a loud muffler and it kept me up at night, I would be all for it, but I just a feeling the enforcement will become extremely broad," says Clapp.
If a citation is written, no points will go against the driver's personal record.
